TERMS OF SERVICE

Thank you for choosing Ty Klopf. By accessing this website, booking services, or purchasing photography products, you agree to the following Terms of Service.

1. Services

Ty Klopf provides professional photography & videography services including, but not limited to, sporting events, camps, games, company events, portraits, team photography, and related media coverage.

2. Booking & Payment

Payment is due in full at the time of booking unless otherwise agreed to in writing. Accepted payment methods include PayPal, Venmo, and major credit or debit cards. Services will not be rendered until payment is received.

3. Photography Sessions

Clients are responsible for arriving on time for scheduled sessions. Transportation, access permissions, or accommodations necessary to conduct the session are not included unless explicitly stated in writing.

4. Rescheduling & Force Majeure

Ty Klopf reserves the right to reschedule or cancel a session due to circumstances beyond reasonable control, including but not limited to severe weather, acts of God, illness, injury, or equipment failure. Such rescheduling or cancellation shall not constitute a breach of contract.

5. Cancellations

All cancellations must be submitted in writing.

  • Cancellations made more than 24 hours prior to the scheduled session may be eligible for a refund of any deposit paid.

  • Cancellations made within 24 hours of the scheduled session will result in forfeiture of the deposit or payment.

6. Copyright & Image Usage

All photographs produced remain the exclusive intellectual property of Ty Klopf. Copyright ownership is not transferred.

Paid clients are granted a non-exclusive, non-transferable license for non-commercial use only, unless otherwise agreed to in writing.

Permitted non-commercial uses include:

  • Personal or educational use

  • Social media and websites

  • Editorial or informational materials

Commercial or revenue-generating use is strictly prohibited without prior written permission, including but not limited to:

  • Advertising or marketing campaigns

  • School, team, or organizational publications

  • Sponsored or paid promotions

  • Merchandise or product sales

  • Fundraising, ticket sales, or sponsorship activation

  • Monetized websites or platforms

  • Third-party or affiliate use

Requests for commercial use must be approved in writing and may require a separate licensing agreement.

7. Unauthorized Use & Violation Fees

Any use of images beyond the scope of this license constitutes a material breach of these Terms. Unauthorized commercial use, redistribution, or sub-licensing will result in a violation fee payable within 30 days of written notice.

Ty Klopf reserves the right to pursue additional legal remedies.

8. Photographer Promotional Use

Unless otherwise agreed to in writing, Ty Klopf retains the right to use images for portfolio display, self-promotion, website content, social media, marketing, and advertising purposes.

9. Limitation of Liability

In the unlikely event of total photographic failure due to unforeseen circumstances, liability shall be limited to a full refund of all monies paid. For partial loss or damage, liability shall be limited to a prorated amount based on the percentage of images lost or damaged.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes shall be resolved exclusively within the courts of the State of Michigan.

11. Acceptance of Terms

By using this website or booking services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
